Q. Why do pharmaceutical manufacturers provide these Patient Assistance Programs?

A. Patient Assistance Programs were created as part of a negotiation with the federal legislature regarding price controls. To avoid price control legislation, manufacturers agreed to provide a means of providing medication to uninsured and/or low-income individuals, and they receive a generous tax credit for their charitable compromise.

Q. What do pharmaceutical manufacturers do with the information that is provided to them about patients and physicians?

A. The medication that is dispensed through manufacturer's patient assistance programs are considered prescription drug products that must be distributed under the Prescription Drug Marketing Act (PDMA). PDMA requires that manufacturers keep very accurate and detailed records regarding the disbursement of prescription medications to prevent fraud and misuse and in case of drug recalls. Therefore, manufacturers are required to collect and store patient and physician information for at least three years for FDA audit purposes. Drug companies also earn a tax deduction for these donations, and must maintain records for IRS audit purposes as well.
